Terms and Conditions

For the rental of the studio space. These terms apply exclusively to entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB). As of September 2026.

This English text is a translation provided for convenience. In case of any discrepancy, the German version is the legally binding one: Allgemeine Geschäftsbedingungen.

1. Subject matter and conclusion of contract

These terms govern the legal relationship between the lessor, Supergreen Studio GbR, Kopenhagener Str. 60-68, 13407 Berlin, and the contractual partner with regard to the reservation or rental of the rooms and equipment named in the document. The document may be a written contract or e-mail correspondence between the lessor and the contractual partner.

These terms apply exclusively to entrepreneurs within the meaning of Section 14 of the German Civil Code (BGB).

Reservations and rentals are made exclusively on the basis of these terms. Any conflicting terms of the contractual partner are hereby rejected. No claim to the conclusion of a rental contract can be derived from an offer by the lessor to conclude a rental contract or a reservation. Likewise, an agreement on an initial reservation for a specific period (“1st option”) does not yet create any payment obligation for the contractual partner.

2. Reservation, binding booking, cancellation, and the binding nature of a granted 2nd option

An option on a date remains in the Supergreen Studio calendar for a maximum of three days. If the lessor does not hear back from the enquiring party within that time, it is deleted automatically.

The lessor will send the contractual partner who has been granted a 1st option a contract form for signature, where appropriate after prior consultation by telephone, so that the reservation made can become a binding rental.

The contractual partner may withdraw from such a written rental contract free of charge up to two weeks before the agreed reservation.

From two weeks before the agreed reservation up to exactly 48 hours before the start of the rental period, cancellation costs of 50% of the agreed amount payable are due.

From less than exactly 48 hours before the reservation, the full amount payable less expenses saved by the lessor is due. Where the lessor is able to rent the space to another party, the cancellation costs are reduced accordingly by the amounts received from that alternative rental.

In all of the above cases, the contractual partner is expressly permitted to prove that the lessor incurred no loss, or a substantially lower loss, than the respective lump sum.

Should a second reservation enquiry (“2nd option”) be received for a period for which a 1st option already exists, and should the lessor grant this 2nd option, the contractual partner holding the 1st option has the opportunity to obtain a binding rental from the lessor as follows:

The lessor will inform the holder of the 1st option that a 2nd option has been granted for the period of the 1st option, and that the contractual partner now has the opportunity to obtain a binding rental from the lessor within 24 hours by confirming a transmitted contract form in writing.

After expiry of a period of 24 hours without a corresponding response from the holder of the 1st option, and the resulting release of the rooms and equipment, the party granted a 2nd option for the same period receives confirmation of a binding rental from the lessor in written or text form. Such a rental to the party initially granted a 2nd option is expressly no longer cancellable.

3. Subletting and house rules

Subletting or any other transfer to third parties is not permitted without the express written consent of the lessor. The contractual partner undertakes to comply with the applicable house rules. Smoking is prohibited throughout the studio, as is open fire (including candles). The contractual partner is obliged to enforce these prohibitions towards their visitors.

The lessee and their entire production are prohibited from using the private workstations in the Supergreen Studio office, or from removing or altering anything there. The subject of the rental contract is exclusively the studio premises on the first floor.

Filming or recording in the courtyard of the Wilhelmhallen (Kopenhagener Str. 60-68, 13407 Berlin) requires the prior permission of the owner.

4. Obligations of the contractual partner

Without further agreement, the contractual partner is not permitted to admit more than 20 (twenty) people to the lessor's studio. The rooms and their equipment remain the unrestricted property of the lessor. The lessor reserves the right of access to all rooms provided and is entitled at any time to enter them personally or to have them entered by authorised persons.

The contractual partner must comply with all official orders and applicable regulations and ensure that all persons involved in the production or event comply with them. The contractual partner is obliged to treat the lessor's property with care. The rooms and equipment are deemed to have been taken over in perfect condition unless any defects are expressly reported upon takeover. The contractual partner must notify the lessor immediately of any damage, defects or losses occurring during the rental period. The contractual partner is directly liable for any damage, even where the damage is to be settled by a third party.

5. Rental period and final cleaning

The rental period for a day rate is 10 hours. For each commenced hour of overtime, additional costs of 10% of the day rate apply.

The agreed rental period must be strictly observed. The premises must be handed over completely cleared and in their original condition at the end of the rental period. Exceptions require the lessor's consent in written or text form. If the contractual partner is in default with clearing and handover, they are liable to the lessor for losses caused by the delay, which may consist, for example, in damages for failure to hand over the rooms on time to a subsequent production.

6. Payment terms and third-party costs

The agreed rent is payable immediately and without deductions upon invoicing by the lessor. The lessor is entitled to invoice the rent or parts thereof in advance by separate agreement. All prices are exclusive of value added tax at the applicable statutory rate.

The contractually agreed rental price is payable in full irrespective of whether the premises or equipment were actually used by the contractual partner to the agreed extent.

A service charge is levied for the organisation and storage of equipment as well as for delivery or collection thereof on the preceding or following day. This amounts to EUR 50.00 per commenced hour, plus value added tax at the applicable statutory rate.

If the contractual partner is in default of payment, the lessor is entitled to charge default interest at the statutory rate (Section 288 BGB). The assertion of further damages caused by default remains unaffected.

7. Liability

The lessor is not liable for ensuring that the use intended by the contractual partner is feasible for factual or legal reasons.

The lessor is liable only for intent and gross negligence on the part of its legal representatives or vicarious agents; in the case of slight negligence, only for the breach of material contractual obligations (cardinal obligations). In such cases, liability is limited to the foreseeable damage typical of the contract at the time the contract was concluded. These limitations of liability do not apply in the case of injury to body, life or health. Strict liability on the part of the lessor is excluded. Insofar as the contractual obligation relates to defects that already existed at the time the contract was concluded or when the rental object was handed over, the lessor is not liable for slight negligence, notwithstanding the above provision.

The lessor ensures a proper supply of electricity, water and heating energy to the rooms. However, the lessor is not liable for damage arising in this connection, in particular through disruptions and interruptions, unless such damage is attributable to intentional or grossly negligent acts or omissions on the part of the lessor. Insofar as disruptions or interruptions are caused by the electricity, water or heating supplier, the claims of the contractual partner are limited to the assignment of the lessor's claims against the relevant supplier. The lessor is likewise not liable for damage caused by voltage drops or voltage fluctuations.

The contractual partner is liable to compensate for damage to and loss of the rooms, the equipment and the building, as well as for damage to property and persons including any consequential damage, insofar as such damage is culpably caused by them, by persons belonging to their production, or by third parties who are present in the rented rooms with their knowledge and tolerance or at their instigation. The contractual partner is obliged to take out adequate liability insurance to cover the aforementioned risks and to provide evidence of this at the lessor's request. The contractual partner indemnifies the lessor against all claims for damages asserted against the lessor by third parties in connection with the production.

The contractual partner is liable for all damage to the rooms and equipment provided in accordance with statutory provisions.

Unless otherwise agreed, personal items or other items brought along in connection with the event are located in the studio at the contractual partner's risk. The contractual partner assumes the duty of guarding and safekeeping in this respect. The lessor is liable for the loss, destruction or damage of such items only in accordance with the liability provisions above.

8. Force majeure

If use of the premises is wholly or partly impossible due to circumstances for which neither party is responsible (for example official orders, failure of building utilities, fire brigade or police operations, natural events), both parties are released from their respective obligations to perform. Amounts already paid will be refunded on a pro rata basis to the extent that the service could not be provided. Any further claims by the parties are excluded in this case.

9. Set-off and right of retention

The contractual partner may only set off claims of the lessor against undisputed counterclaims or counterclaims that have been established as final and binding. The contractual partner is entitled to exercise a right of retention only insofar as their counterclaim is based on the same contractual relationship.

10. Own promotional use

For the purposes of its own promotion to an extent customary in the industry (for example website, brochures, showreel), the contractual partner permits the lessor to take and use photographs of the set built by the contractual partner. However, no persons belonging to the contractual partner's production will be depicted in these photographs unless they have expressly consented. Further information on the processing of personal data can be found in the lessor's privacy policy.

11. Ancillary agreements, jurisdiction, severability

Amendments and additions to the contract and to these terms must be made in writing. No verbal ancillary agreements have been made. German law applies. The place of jurisdiction is Berlin, to the extent legally permissible. Should individual provisions of this contract be or become wholly or partly invalid, the validity of the remaining parts of the contract shall not be affected. The parties undertake to replace the invalid provision with a valid one that comes as close as possible to the legal and economic purpose of the invalid provision. The same applies to gaps in the provisions.
